His had a minor car accident 13 months ago. Accident deemed to be his fault. Accident at low speed. Under 10km. Both cars suffered minimal damage. Slight marks of scratching / buff on cars. No bumpy panels. About 2 months after the accident, his insurance company CTP sent an investigator to get an official statement of events from him. A 3 hour interview process to discuss a minor car accident. He duly provided the statement and this is the last time he has heard of it. His third-party property insurance company settled his claim for his bumper to be repaired. He did not even bother to repair his car because the damage was minimal. This week, he received a court summons for a civil case. The other driver claims to have an incapacity for work, medical expenses, anxiety, insomnia and loss of enjoyment of leisure. To be clear, it was a very small car accident. On the surface, his claim is complete bullsh! T I guess we should just pass this summons to his CTP insurer and face them? Why do not their lawyers simply direct the claim to the CTP company in the first place? I understand that lawyers can not go directly to CTP because it's your son's policy, not theirs. They make a claim against your son, and your son files a claim with CTP to take care of him on his behalf. Your son probably has nothing to fear other than having to pay any excess that applies. It looks like a \no win / no pay\ outfit, trying to get everything they can. I would not be too worried, but he should definitely talk to his insurer and might not mind having a quick conversation with a lawyer. * Sigh * I have a family member who did something similar. They are probably the worst driver I know, usually half asleep or under the influence of illicit drugs.
