Typical Attorney Fees For Personal Injury


Last week Axa became the first insurer to refuse referral fees but other insurers will not budge on the issue. Aviva said its position "remains unchanged". A spokesman said: "We are still calling for full implementation of the Jackson Review for the complete banning of these fees. We do not sell bulk customer claims data and only pass on information when it is directly relevant and only then do we take payment. But the amount we receive in referral fees is a fraction of what they cost us."

Lord Justice Jackson's Review of Civil Litigation Costs outlined proposals that companies should be banned from selling personal injury cases to lawyers for a fee. The industry is now waiting to see if the Government will implement the review's proposals.

RBS Insurance, the company behind big insurance brands Churchill and Direct Line, did not deny that it sold policyholder's details but said it would do so only when it felt it was appropriate.

An RBS spokesman said: "We do not pass on or sell customers' details to personal injury lawyers or accident management companies on a speculative basis. We do refer our customers who have been in a genuine accident to a selected panel of solicitors to pursue a legitimate personal injury claim. In the current imperfect market this is in the best interest of our customers."

The AA denied that it sold on policyholders' details and said it would pass on details only if requested by the customer or with their express consent.
