Personal Injury Lawyer In Oklahoma City


A couple filed a lawsuit alleging the city's negligence caused the sewage to back up into their northeast Muskogee home. 

Elliott and Penny Kampf allege the sewage backup caused "extensive damage" and "personal injury." In their petition, which was filed in Muskogee County District Court, they allege the backup and resulting damage was caused by the city's failure to maintain its sewer system.

Deputy City Attorney Matthew Beese said the Kampfs filed a tort claim notice after the event, which allegedly occurred Sept. 6. That claim, he said, was denied by the city's insurer, the Oklahoma Municipal Assurance Group, which allowed the couple to move forward with the lawsuit. 

Historical weather data show there was no precipitation or adverse weather conditions during the days that preceded the alleged sewer backup. Increased stormwater flows have proven to be problematic for the city's wastewater system in the past.

"The problem with sewer backups are the unknowns — it's an unknown system," Beese said, noting the city has yet to be served with the petition and summons. I have started to compile all of our records. Normally, when there is a sewer backup we ask for things related to that address, depending on the issue, and the related vicinity."
