The Ohio Supreme Court on Tuesday reprimanded a Beachwood lawyer who took on a driver and passenger as clients in an injury case, only to later represent one while suing the other. (PD file)

COLUMBUS, Ohio -- The Ohio Supreme Court publicly reprimanded a Beachwood lawyer Tuesday who took on a driver and passenger as clients in an injury case, only to later represent one while suing the other.

The Cleveland Metropolitan Bar Association filed the professional misconduct complaint earlier this year against attorney Robert Stanley Leiken of Beachwood.

Leiken was retained by a driver and his passenger to recover damages for injuries suffered in an automobile accident, according to the Supreme Court. But later, the driver was alleged to have been comparatively negligent in the accident.

Leiken ultimately stopped representing the driver and instead brought suit against him on behalf of the passenger.

In a unanimous opinion, the Supreme Court noted that Leiken had admitted violating rules that bar an attorney from representing clients who have adverse interests in the same case or taking on a client whose interests are materially adverse to of a former client.

In issuing the public reprimand, the court noted Leiken had no previous record of disciplinary action, had cooperated in the disciplinary proceeding and had taken steps to correct the misconduct.
